To access certain features of the Services, you must create an account. When creating an account, you agree to:

Growtio provides AI-powered marketing automation tools and services, including but not limited to:

• AI-generated ad copy and creative content
• Multi-platform campaign management (Google, Meta, TikTok)
• Marketing analytics and performance tracking
• ROI prediction and optimization tools
• A/B testing and audience targeting features

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

You are responsible for:

• All content you create, upload, or distribute through the Services
• Ensuring your use complies with all applicable laws and regulations
• Obtaining necessary rights and permissions for any content you use
• Maintaining accurate billing and contact information
• Complying with advertising platform policies (Google, Meta, TikTok)

You acknowledge that AI-generated content may require review and editing before publication. Growtio does not guarantee that AI-generated content will be suitable for all purposes or compliant with all advertising regulations.

Subscription Plans: Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.

Lifetime Deals: Lifetime access purchases are one-time payments that grant perpetual access to the specified plan features as they exist at the time of purchase and future updates.

Refunds: Please refer to ourRefund Policyfor information about refund eligibility and procedures.

Price Changes: We may change our prices with 30 days' notice. Price changes will not affect current subscription periods.

Taxes: You are responsible for all applicable taxes. Prices displayed may not include taxes, which will be calculated at checkout based on your location.

Our Property: The Services, including all content, features, and functionality, are owned by Growtio and are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of content you create using our Services. By using the Services, you grant us a non-exclusive license to use, store, and process your content solely to provide the Services.

AI-Generated Content: Content generated by our AI tools based on your inputs belongs to you, subject to any underlying third-party rights and our license to use aggregated, anonymized data to improve our Services.

You agree not to use the Services to:

• Violate any applicable laws, regulations, or third-party rights
• Create or distribute misleading, deceptive, or fraudulent content
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Engage in spam, phishing, or unauthorized data collection
• Circumvent or disable security features of the Services
• Resell, sublicense, or provide access to the Services without authorization
• Use automated systems to access the Services except as permitted
• Create advertisements for illegal products or services
• Generate content that promotes hate, violence, or discrimination

By You: You may terminate your account at any time by contacting us or using the account settings. Upon termination, your right to use the Services will immediately cease.

By Us: We may suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. We will provide notice when reasonably possible.

Effect of Termination: Upon termination, all licenses granted to you will terminate. You may request a copy of your data within 30 days of termination. We may retain certain information as required by law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the Services, including advertising performance, ROI, or conversion rates.

AI-generated content is provided for informational purposes and should be reviewed before use. We are not responsible for the accuracy, legality, or appropriateness of AI-generated content.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Growtio and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or distribute through the Services

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Informal Resolution: Before filing a formal dispute, you agree to contact us at legal@growtio.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date.

For material changes, we will provide at least 30 days' notice before the changes take effect. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.
